Abstract

Cita-cita bangsa Indonesia dituangkan dalam Pasal 28 H ayat (1) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 yang menyatakan antara lain bahwa setiap orang berhak memperoleh pelayanan kesehatan. Pelayanan kesehatan dilakukan oleh tenaga kesehatan antara lain perawat dalam bentuk asuhan keperawatan. Profesi perawat dalam pelayanan asuhan keperawatan di rumah sakit paling banyak dibandingkan dengan tenaga kesehatan lain dan paling sering berinteraksi dengan pasien dan keluarganya. Peraturan internal staf
keperawatan mengenai kredensialing diatur dalam UU No.38 Tahun 2014 tentang Keperawatan dan Permenkes No.26 Tahun 2019 tentang Peraturan Pelaksanaan UU No.38 Tahun 2014 tentang Keperawatan. Faktanya Rumah sakit belum semua
melaksanakannya, yang berakibat dapat merugikan pasien. Permasalahan yang timbul 1) Mengapa kredensialing pelayanan asuhan keperawatan di rumah sakit belum berkeadilan? 2) Bagaimana pengaturan terhadap peraturan internal staf
keperawatan yang berkeadilan mengenai kredensialing pelayanan asuhan keperawatan di rumah sakit saat ini? 3) Bagaimana penguatan pengaturan terhadap peraturan internal staf keperawatan yang berkeadilan mengenai kredensialing pelayanan asuhan keperawatan di rumah sakit? Metoda penelitian yuridis empiris dengan menggunakan data primer (wawancara) yang didukung data sekunder, dengan spesifikasi penelitian secara preskriptif analitis. Penelitian kualitatif berorientasi pada paradigma post positivism, peneliti mengobservasi secara langsung untuk mendapatkan sebuah realitas, oleh karena itu dibutuhkan metode triangulasi untuk mengumpulkan berbagai sumber data dan informasi. Hasil penelitian; 1) Perawat menjalankan tugasnya belum sesuai dengan jenjang dan kompetensinya sehingga berdampak pada pelayanan yang dapat merugikan pasien, disebabkan faktor internal dan eksternal 2) Pengaturan terhadap Peraturan internal staf keperawatan mengenai kredensial lemah, belum semua rumah sakit melaksanakannya. Kredensial merupakan elemen kunci dalam menurunkan risiko
litigasi (gugatan hukum di pengadilan) terhadap rumah sakit dan tenaga keperawatan yang bekerja didalamnya.3) Penguatan Pengaturan terhadap Peraturan internal staf keperawatan mengenai kredensialing pelayanan asuhan keperawatan di rumah sakit yang berkeadilan sehingga baik pasien maupun perawat tidak ada yang dirugikan, dengan menambah frasa pada pasal 17 (a) dan pasal 58 ayat (1) UU RI No. 38 Tahun 2014 tentang Keperawatan, pasal 12 ayat (5) dan pasal 39 ayat (1) UU RI No.44 Tahun 2009 tentang Rumah Sakit dan pasal 28 ayat (11) Permenkes No.26 Tahun 2019 tentang Peraturan Pelaksanaan
UU No.38 Tahun 2014 tentang Keperawatan.
Rekomendasi bagi legislatif agar memperkuat pengaturan terhadap peraturan internal staf keperawatan, dukungan
political will manajemen rumah sakit untuk meningkatkan peran komite keperawatan.

The ideals of the Indonesian nation are set forth in Article 28 H paragraph (1) of the 1945 Constitution of the Republic of Indonesia which states, among other things, that everyone has the right to obtain health services.
Health services are carried out by health workers, including nurses in the form of nursing care. The profession of nurses in nursing care services in hospitals is the most numerous compared to other health workers and most often interacts with patients and their families. Internal regulations for nursing staff regarding credentials are regulated in Law No. 38 of 2014 concerning Nursing and Permenkes No. 26 of
2019 concerning Regulations for Implementing Law No. 38 of 2014 concerning Nursing. The fact is that not all hospitals implement it, which can result in harm to the patient. Problems that arise 1) Why is the credentialing of nursing care services in hospitals not fair? 2) What are the arrangements for internal regulations for nursing staff that are fair regarding the current credentialing of nursing care services in hospitals? 3) How to strengthen the regulation of fair nursing staff internal regulations regarding the credentialing of nursing care services in hospitals? The empirical juridical research method uses primary data
(interviews) supported by secondary data, with analytical prescriptive research specifications. Qualitative research is oriented to the post-positivism paradigm, researchers observe directly to get a reality, therefore a triangulation method is needed to collect various sources of data and information. Research result; 1) Nurses do not carry out their duties according to their level and competence so
that it has an impact on services that can harm patients, due to internal and external factors 2) Regulations for internal nursing staff regarding weak credentials, not all hospitals implement them. Credentials are a key element in
reducing the risk of litigation (lawsuits in court) against hospitals and nursing staff working in them. 3)Strengthening the Arrangements for Internal Regulations for nursing staff regarding credentialing nursing care services in hospitals that are fair so that neither patients nor nurses those who are harmed, by adding phrases to Article 17 (a) and Article 58 paragraph (1) of RI Law No. 38 of 2014 concerning Nursing, article 12 paragraph (5) and article 39 paragraph (1) RI Law No. 44 of 2009 concerning Hospitals and article 28 paragraph (11) Permenkes No. 26 of 2019 concerning Regulations for Implementing Law No. 38 of 2014 2014 concerning Nursing. Recommendations for the legislature to strengthen regulation of internal regulations for nursing staff, support for hospital management's political will to increase the role of the nursing committee.
