DEKONSTRUKSI PERATURAN PEMILIHAN KEPALA DESA YANG DEMOKRATIS UNTUK MEWUJUDKAN GOOD GOVERNANCE

Desa memiliki peran dalam mewujudkan cita-cita kemerdekaan berdasarkan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 (UUD NRI Tahun 1945). Pemilihan Kepala Desa (Pilkades\) merupakan suatu Pemilu yang menganut sistem demokrasi yang dapat membebaskan warga masyarakatnya untuk mempunyai hak atas kebebasan berpendapat. Pilkades selama ini masih diwarnai dengan berbagai kecurangan pada sebelum, saat, dan setelah pelaksanaan Pilkades tidak dapat dipungkiri memicu konflik vertikal maupun konflik horizontal. Permasalahan dalam penelitian ini diataranya: (1) Bagaimana peraturan Pilkades yang demokratis saat ini ? (2) Mengapa Pilkades sekarang ini belum mewujudkan good governance ? dan (3) Bagaimana dekonstruksi peraturan Pilkades desa yang demokratis untuk mewujudkan good governance ? Penelitian ini menggunakan tipe penelitian yuridis normatif empiris, suatu penelitian yang menggunakan data sekunder sebagai data utamanya, sedangkan data primer sebagai data pendukung. Penelitian ini menggunakan pendekatan perundang-undangan, pendekatann konsepptual, pendekatan perbandingan, dan pendekatan kasus. Hasil penelitian menunjukkan bahwa: (1) Peraturan Pilkades yang demokratis saat ini diatur dalam Undang-Undang Nomor 3 Tahun 2024 dapat memastikan bahwa proses pemilihan yang dilakukan adalah adil, transparan, dan akuntabel, serta dapat memilih pemimpin yang tepat untuk memimpin desa. Ketentuan dalam Permendagri Nomor 112 Tahun 2014 tentang Pemilihan Kepala Desa tidak mengatur dengan jelas terkait penyelesaian perselisihan hasil Pilkades dan tidak adanya upaya penyelesaian terkait calon Tunggal dalam pemilihan kepala desa. (2) Pilkades sekarang ini belum mewujudkan good governance disebabkan karena faktor internal yaitu kurangnya pemahaman aparatur terhadap prinsip-prinsip good governance, dan kurangnya disiplin aparatur di waktu jam kerja dapat menyebabkan aparatur tidak dapat bekerja dengan efektif dan efisien. Sedangkan faktor eksternal yaitu: Pertama, kurangnya partisipasi masyarakat dapat menyebabkan masyarakat tidak dapat berpartisipasi dalam proses pengambilan keputusan dan tidak dapat memantau kinerja aparatur, dan kurangnya pengawasan dari lembaga yang terkait dapat menyebabkan aparatur tidak dapat diawasi dengan baik dan tidak dapat dipertanggungjawabkan. (3) Dekonstruksi Peraturan Pilkades yang demokratis untuk mewujudkan good governance dapat dilakukan dengan memperkuat sistem administrasi negara, meningkatkan partisipasi masyarakat, dan meningkatkan transparansi dan akuntabilitas. Dekonstruksi pelaksanaan Pilkades dapat dilakukan dengan adanya pemahaman yang jelas tentang prinsip-prinsip good governance, seperti transparansi, akuntabilitas, partisipasi, dan keadilan. Selain itu juga perlu adanya perubahan dalam sistem pemilihan, seperti pemilihan langsung, pemilihan oleh dewan perwakilan, atau kombinasi keduanya. Hal ini dapat dilakukan dengan memperbarui peraturan dan undang-undang yang terkait dengan Pilkada.

Villages have a role in realizing the ideals of independence based on the 1945 Constitution of the Republic of Indonesia (UUD NRI 1945). The Election of Village Heads (Pilkades) is an election that adheres to a democratic system that can free its citizens to have the right to freedom of opinion. Pilkades has so far been marked by various frauds before, during, and after the implementation of Pilkades, which cannot be denied, triggering vertical and horizontal conflicts. The problems in this study include: (1) What are the current democratic Pilkades regulations? (2) Why has the current Pilkades not realized good governance? and (3) How is the deconstruction of democratic village Pilkades regulations to realize good governance? This study uses an empirical normative juridical research type, a study that uses secondary data as its main data, while primary data as supporting data. This study uses a legislative approach, a conceptual approach, a comparative approach, and a case approach. The results of the study show that: (1) The current democratic Village Head Election Regulations regulated in Law Number 3 of 2024 can ensure that the election process is fair, transparent, and accountable, and can elect the right leader to lead the village. The provisions in the Minister of Home Affairs Regulation Number 112 of 2014 concerning Village Head Elections do not clearly regulate the resolution of disputes over Village Head Election results and there are no efforts to resolve issues related to Single Candidates in Village Head Elections. (2) The current Village Head Election has not realized good governance due to internal factors, namely the lack of understanding of the apparatus regarding the principles of good governance, and the lack of discipline of the apparatus during working hours can cause the apparatus to be unable to work effectively and efficiently. While external factors are: First, the lack of community participation can cause the community to be unable to participate in the decision-making process and unable to monitor the performance of the apparatus, and the lack of supervision from related institutions can cause the apparatus to not be supervised properly and cannot be accounted for. (3) Deconstruction of the democratic Village Head Election Regulations to realize good governance can be done by strengthening the state administration system, increasing community participation, and increasing transparency and accountability. Deconstruction of the implementation of Pilkades can be done with a clear understanding of the principles of good governance, such as transparency, accountability, participation, and justice. In addition, there also needs to be a change in the election system, such as direct elections, elections by the representative council, or a combination of both. This can be done by updating the regulations and laws related to Pilkada.
